These Subscriber Terms of Use("Subscriber Terms" or "Terms") govern your account andyour use of all SureVoter products and services, including the Lens briefingproduct and, when it launches, the full SureVoter platform (collectively, the"Service"), operated by SureVoter LLC, a Delaware limited liabilitycompany ("SureVoter," "we," "us," or"our").
These Subscriber Terms areseparate from and supplement our Website Terms of Service, which governanonymous visitor access to surevoter.com. If there is a conflict between theseSubscriber Terms and the Website Terms, these Subscriber Terms control withrespect to your account and use of the Service.
PLEASE READ THESE TERMS CAREFULLY. BYSUBMITTING YOUR EMAIL ADDRESS ON ANY SUREVOTER OR LENS SIGNUP FORM, YOU AGREETO BE BOUND BY THESE SUBSCRIBER TERMS AND OUR PRIVACY POLICY. IF YOU DO NOTAGREE, DO NOT SIGN UP.
Your agreement to theseSubscriber Terms is formed at the moment you submit your email address on aSureVoter or Lens signup form. The statement displayed at the point of signup —"By submitting your email address, you agree to SureVoter's SubscriberTerms of Use and Privacy Policy" — constitutes your notice and youracceptance. No further action is required to create a binding agreement.
You represent that: (a) you areat least 18 years of age; (b) you are a resident of the United States; (c) youhave the legal authority to enter into these Terms; and (d) all information youprovide is accurate and current.
SureVoter reserves the right tomodify, amend, or replace these Subscriber Terms at any time and for anyreason, in our sole discretion. This product is in active development and theseTerms will evolve as new features launch, including the full SureVoter CivicProfile and platform.
When we make material changes,we will: (a) update the "Last Updated" date at the top of this page;and (b) notify you via email to your registered address at least 14 days beforethe changes take effect, except where immediate changes are required by law.
Your continued use of theService after changes take effect constitutes your acceptance. If you do notagree to updated Terms, you may close your account by contactinglegal@surevoter.com.
The Lens is SureVoter's firstproduct — a multi-perspective civic news briefing tool that delivers:
• Personalized email digests (daily or weekly) coveringnews on the political issues and topics you select
• An online Newsroom Hub — a filterable, issue-organizedfeed of current news coverage across five source tiers
• Article pages showing AI-generated perspectivesummaries from multiple source tiers with links to original sources
• A smart issue-selection and watchlist system allowingyou to follow specific topics, legislation, and policy areas
• A shareable article page format — publicly accessible,no login required, optimized for social sharing
SureVoter is building a broadercivic operating system. When it launches, it will allow subscribers to create afull Civic Profile, track their elected representatives' voting records andpositions, and engage more deeply with the civic process. If you have a Lensaccount, your account will transition to the full platform automatically — nore-registration required. Additional consent steps and a supplemental termsnotice will be provided at that time.
• Lite Account (Lens signup): Created upon emailsubmission. Holds your email address, issue preferences, digest cadence, andsource tier preference. No password required. Authenticated via magic link.
• Full Account (Civic Profile, coming soon): Activatedwhen you choose to complete your Civic Profile. Will include additionalpersonal information, politically sensitive preference data, and enhanced civicfeatures. Subject to a separate consent flow at the time of activation.
You will never be forced toupgrade from a Lite Account. Lens-only access continues indefinitely forsubscribers who do not activate a Civic Profile.
The Service uses passwordlessauthentication. You access your account via a secure magic link sent to yourregistered email address. Each magic link session remains active for 7 days.After expiration, you may request a new link at any time from the Service.
You are responsible for: (a)maintaining access to the email account you registered with; (b) keeping yourregistered email address current; (c) notifying us promptly atlegal@surevoter.com if you believe your email account has been compromised; and(d) not sharing your magic link with others or permitting unauthorized use ofyour session.
SureVoter is not responsible forlosses resulting from unauthorized session access due to your failure to secureyour email account. Optional password and bookmark prompts are available aftermagic link authentication — we encourage you to use them for convenience.
You may use the Service only forlawful, personal, non-commercial civic information purposes consistent withthese Terms. You agree not to:
• Violate any applicable federal, state, or local law orregulation in connection with your use of the Service
• Attempt to access, scrape, or systematically downloadService content using automated tools, bots, or scripts
• Attempt to bypass, circumvent, or interfere with anyauthentication, security, or access control mechanism
• Use the Service to transmit unsolicited commercialcommunications, spam, or malicious content
• Impersonate any person or entity, or misrepresent youraffiliation with any person or entity
• Use the Service for political campaign activity,candidate fundraising, or partisan political advertising without our expressprior written consent
• Reverse engineer, decompile, or attempt to extractsource code or proprietary algorithms from any part of the Service
• Use the Service in any way that could damage,overburden, or impair our systems or interfere with other users
• Share, resell, or commercially exploit your access tothe Service or any Service content
The Lens uses artificialintelligence to generate multi-perspective summaries, pull quotes, anddivergence analyses from news articles. These outputs are created bySureVoter's AI systems and stored in our Perspective Store — they are generatedat the time of article ingestion, not in response to your page load. When youview an article page, you receive cached, pre-generated AI content.
AI-generated content is intendedto help you understand divergent framing across news sources. It is not asubstitute for reading original journalism. AI systems can produce errors,omissions, or mischaracterizations. SureVoter makes no warranty as to theaccuracy, completeness, or reliability of AI-generated content. We disclaim allliability for AI errors to the fullest extent permitted by law.
SureVoter does not reproducefull articles. Article pages display: (a) AI-generated summaries derived fromnews content under fair use principles; (b) brief pull quotes not exceeding 50words per quote, limited to 2 quotes per source per story thread; and (c)prominent outbound links to original source articles. For Tier B sources (hardpaywall or AI-summarization-restricted outlets), only the headline and anoutbound link are displayed — no article body is processed.
SureVoter's use of third-partynews content is governed by fair use principles (17 U.S.C. § 107),source-specific terms of service review, and applicable copyright law. OurPublisher Content Use Policy (surevoter.com/legal/publisher-policy) describesour source tier framework and publisher rights in detail.
The Lens classifies news sourcesinto coverage tiers based on editorial type — not bias ratings. SureVoter doesnot label any news source as "biased" or "unbiased." Tierdesignations (Wire/Neutral, Center-Left, Center-Right, Left Commentary, RightCommentary) reflect the editorial character of each source as assessed by AllSides.com.No tier assignment constitutes an endorsement or condemnation of any source.
The Service and all of itscontents — including the SureVoter name, Lens brand, logos, productarchitecture, AI systems, divergence scoring methodology, issue taxonomy,watchlist resolution engine, and all proprietary data structures — are owned bySureVoter LLC and protected by applicable intellectual property law.
Your subscription grants you alimited, personal, non-exclusive, non-transferable license to access and usethe Service for personal, non-commercial civic information purposes. Thislicense does not include any right to: resell or sublicense the Service;publicly display or perform Service content; reproduce, copy, or createderivative works; or access the Service through automated means.
By signing up for the Lens, youconsent to receive the following transactional emails:
• Your selected email digest (daily or weekly, per yourcadence preference)
• Magic link authentication emails
• Account-related notifications (preferenceconfirmations, account updates, session management)
• Material updates to these Terms or our Privacy Policy
These transactional emails are acore delivery mechanism of the Lens. You may unsubscribe from digest emails atany time via the unsubscribe link in any email. Unsubscribing from digestseffectively disables the email delivery feature of your account but does notclose your account.
SureVoter may offer you theoption to receive marketing communications and product announcements about thebroader SureVoter platform. This is a separate, optional checkbox at signup —unchecked by default. Agreeing to marketing emails is not required to use theLens or any other Service feature. You may withdraw marketing email consent atany time via unsubscribe link or by contacting legal@surevoter.com.
All SureVoter emails comply withthe CAN-SPAM Act. Every email includes clear sender identification, ourphysical mailing address (2810 N Church St #548750, Wilmington, DE 19802), anda functional unsubscribe mechanism. Unsubscribe requests are honored within 10business days. Transactional and marketing email consent are managed separatelyin our email systems.
Your use of the Service isgoverned by our Privacy Policy (surevoter.com/legal/privacy-policy),incorporated into these Terms by reference. Key data facts for Lens subscribersat launch:
• We collect: your email address, issue and topicpreferences, digest cadence, source tier preference, engagement data (opens,clicks, shares), and watchlist topics
• We do not collect: your name, phone number, password,or political party affiliation at Lens signup
• We do not sell your personal information to thirdparties for their marketing purposes
• Your issue preferences and engagement data are used topersonalize your Lens experience and, with your future consent, your CivicProfile
When the full SureVoter CivicProfile launches and you choose to activate it, you will receive a separate,affirmative consent flow covering the collection of politically sensitive data— including your perspective on political issues and any civic alignmentanalysis we generate. You will have meaningful control over that data and howit is used. Civic Profile data constitutes "sensitive personalinformation" under applicable state privacy laws and will be handledaccordingly.
Lens article pages are publiclyaccessible — no login is required to view a shared article page. When you sharean article page link, anyone who clicks it can read the full multi-perspectivesummary without an account. This is by design: the Lens is built to drive civicperspective into public conversations.
Share links are trackedserver-side (referral source, story thread, issue, and conversion to signup).Tracking parameters are not visible in the URL. This data is used to measureorganic growth and the k-factor of share-driven acquisition. It is handled inaccordance with our Privacy Policy.
Article pages are ungated andpublicly accessible. When a visitor — logged in or anonymous — moves from anarticle page into the SureVoter Newsroom or other platform features, accesscontrols apply:
• Anonymous visitors: see top 3 Newsroom stories in full;additional stories are blurred with an inline email gate
• Lens subscribers: full Newsroom access, personalized bytheir selected issues and source preferences
• Full Civic Profile features (when launched): gatedbehind Civic Profile activation, not behind a paywall
SureVoter does not have a paidsubscription tier. Gating is used for account creation, not monetization.
The Service links to anddisplays content from third-party news organizations. SureVoter has no controlover third-party websites and is not responsible for their content, legality,or practices. Outbound links are provided for informational convenience and donot constitute endorsement.
The Service integrates withthird-party technology providers — including email delivery, analytics, and AIinfrastructure providers — described in our Privacy Policy and AI Disclosure.All providers are bound by data processing agreements consistent withapplicable law and our Privacy Policy.
SureVoter respects theintellectual property rights of news publishers and is committed to being ameaningful referral channel for original journalism. Our Publisher Content UsePolicy (surevoter.com/legal/publisher-policy) describes our source tier framework,content processing practices, and publisher options including tierreclassification, removal, and licensing.
Publishers and content rightsholders may contact us at publishers@surevoter.com. We respond to publisherinquiries within 5 business days.
SureVoter offers and plans tooffer API access to certain Lens data and embed capabilities for approvedinstitutional partners — including educational institutions, libraries,nonprofit organizations, and other approved categories. API access is subject toa separate API License Agreement.
Unauthorized use of SureVoter'sdata, endpoints, or content through scraping, reverse engineering, or any othermeans is strictly prohibited and may violate these Terms, the Computer Fraudand Abuse Act, and applicable copyright and intellectual property law.
THE SERVICE IS PROVIDED "ASIS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BYAPPLICABLE LAW, SUREVOTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED,INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANDNON-INFRINGEMENT. SUREVOTER DOES NOT WARRANT THAT THE SERVICE WILL BEUNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.SUREVOTER MAKES NO WARRANTY AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OFANY AI-GENERATED CONTENT.
SUREVOTER IS NOT A NEWSORGANIZATION, GOVERNMENT ENTITY, OR ELECTION AUTHORITY. NOTHING IN THE SERVICECONSTITUTES LEGAL, ELECTION, CIVIC, OR POLITICAL ADVICE. ALWAYS VERIFYIMPORTANT INFORMATION WITH PRIMARY SOURCES AND YOUR OFFICIAL LOCAL ELECTIONAUTHORITIES.
TO THE FULLEST EXTENT PERMITTEDBY APPLICABLE LAW, SUREVOTER, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES,AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS,USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATING TO YOURUSE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL SUREVOTER'STOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAIDSUREVOTER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS($100). BECAUSE THE SERVICE IS CURRENTLY FREE, THIS MEANS SUREVOTER'S AGGREGATELIABILITY IS CAPPED AT $100.
You agree to defend, indemnify,and hold harmless SureVoter and its affiliates, officers, directors, employees,and agents from and against any claims, liabilities, damages, awards, losses,costs, and fees (including reasonable attorneys' fees) arising out of orrelating to: (a) your violation of these Terms; (b) your use of the Service inan unauthorized manner; or (c) your violation of any third-party rights.
These Subscriber Terms aregoverned by the laws of the State of Delaware, without regard to conflict oflaw provisions.
IMPORTANT: BY AGREEING TO THESE TERMS,YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHERTHAN IN COURT, AND YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
Any dispute, claim, orcontroversy arising out of or relating to these Terms, the Privacy Policy, orthe Service that cannot be resolved informally shall be submitted to bindingindividual arbitration administered by JAMS under its Streamlined ArbitrationRules and Procedures. The arbitration shall take place in Delaware orvirtually. The arbitrator's decision shall be final and binding and may beentered as a judgment in any court of competent jurisdiction.
YOU AND SUREVOTER EACH AGREETHAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS APLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, ORREPRESENTATIVE ACTION.
Either party may bring anindividual action in small claims court for disputes within that court'sjurisdiction, without first completing the arbitration process.
Before initiating arbitration,you agree to contact us at legal@surevoter.com and provide a writtendescription of the dispute, the relief sought, and your contact information. Weagree to attempt good-faith resolution within 30 days. This informal process isa prerequisite to arbitration.
SureVoter may suspend orterminate your account and access to the Service at any time, with or withoutcause and with or without notice, including for violation of these Terms orconduct that we determine, in our sole discretion, to be harmful to the Serviceor other users.
You may close your account atany time by emailing legal@surevoter.com. Upon account closure, we will deleteyour personal data consistent with our Privacy Policy and applicable law. Youmay also request data deletion without closing your account by emailingprivacy@surevoter.com.
The following sections survivetermination: 6.4, 12, 13, 14, 15, 16, 17, and 19.
SureVoter may assign, transfer,or delegate its rights and obligations under these Terms — including operationof the Service and any collected personal data — to any successor entity,affiliate, or third party in connection with a merger, acquisition, reorganization,or transfer of assets, provided that the transferee agrees to honor theseTerms.
• Entire Agreement: These Subscriber Terms, the WebsiteTerms of Service, the Privacy Policy, and the AI Disclosure together constitutethe entire agreement between you and SureVoter with respect to the Service.
• Severability: If any provision is found invalid orunenforceable, the remaining provisions remain in full force.
• No Waiver: Failure to enforce any right does notconstitute a waiver of that right.
• Notices: We provide notices via email or by posting onthe Service. Notices to us must be sent to legal@surevoter.com.
• Force Majeure: SureVoter is not liable for delays orfailures due to circumstances beyond our reasonable control.
